A Forgotten Balance Does Not Stay at the Casino

The US law of escheat and those of the individual states govern unclaimed property. The law of unclaimed property requires the casino, or the operator of the gaming site, to give notice to the rightful owner that the money will be thought of as dormant. To the law, that means the owner has gone untouched for a defined dormancy period, often three years for many harder to categorize properties. The operator then reports the balance. Although the operator holds those dollars in escrow, they must stop doing so after the dormancy period or at a sooner state-set date. The balance in that untouched, uncharged, account then has a new custodian under state law, and that custodian is specifically the state itself, or, instead, the department or office within the state that regulates unclaimed property otherwise defined by that state's laws. Each state has adopted variations of the Revised Uniform Unclaimed Property Act, which defines dormancy periods. Whether the casino honours the default period or sets one itself, or the state gives an extension, counting an untouched balance begins from the last activity in the account.

Handing a balance to the state does not end the window to claim it. Under state unclaimed property law, the custodian of an unclaimed casino balance (or other relevant financial property, like funds or credits) is a department, office, or programme of that individual state. Once handed over as escheat property, the title claim involves seeking that balance from the state programme in the state of the unclaimed property.

Each state is supposed to send the rightful owner an annual notice, detailing additional information available in claims. But with casinos and the few US states that legalize internet gaming, notice is often more haphazard. A search by way of a particular state's unclaimed property programme is a recent and often more reliable way to find out if a balance is held by that custodian.

What resets the clock

A balance may reset the dormancy clock. By implication, your identity and activity do sometimes matter for the calculating state dormancy clock. Activity on the gaming account that resets it must be defined as such by that casino and within the state's law. Businesses that own casino accounts (B2B transactions like gift cards or credit purchases) may reset differently than those owned by individuals. Even logging in can bring notice to the operator, and open up a subsequent notice to the patient owner.

But as a result, a login can be defined by some casinos as not enough activity to reset the dormancy. A few key protective measures include a small stake refunded back to you and logging in regularly, for example. Closing the account and dismissing the balance are two different events. What the terms can charge in the meantime

Note: dormancy is a legal definition. While a casino may close an empty account, and that closure is another affair, escheat is when the casino reports account as unclaimed to the appropriate state regulator, which thence has custody of that dormant custodian. Also, keep in mind that where to submit an individual income tax on the balance depends on which state's custodian holds the money, not where originally deposited.
